ExceptionNation.com publishes personal documentation of the founder's own medical experiences and decisions. All content — including Exception Chronicles, articles, videos, and any consulting communication — is personal experience narrative, not medical advice, clinical guidance, diagnosis, or treatment recommendation.

Nothing on this site creates a provider-patient relationship. Nothing here should be used as a substitute for consultation with a licensed medical professional. Exception Nation LLC holds no medical license and does not offer medical services in any form.

By using this site or purchasing any product, you acknowledge this distinction and agree that all health-related decisions remain solely your own.

1. Who You Are Contracting With

These Terms of Service ("Terms") govern your access to and use of ExceptionNation.com and any products, memberships, or services offered through it. The contracting party is:

By accessing ExceptionNation.com, purchasing any product, enrolling in any membership, or engaging any consulting service, you agree to these Terms. If you do not agree, do not use this site or purchase any product.

2. What Exception Nation Is

Exception Nation is a digital health nonfiction documentation property. All content published here — written, video, audio, or otherwise — documents the personal experience of the founder, who has navigated significant medical circumstances since childhood without accepting surgical or pharmacological interventions he chose not to accept.

Exception Nation does not purport to offer medical expertise, clinical judgment, or transferable health guidance. Content is published under a personal-narrative framework consistent with Google's Experience, Expertise, Authoritativeness, and Trustworthiness (E-E-A-T) standards for health-adjacent publishing: the author writes from direct lived experience, clearly identified as such, with no implied professional credentials beyond that experience.

The site's scope is documentation and education. It is not a medical practice, a wellness clinic, a coaching program, or a treatment service.

3. Products and Pricing

Exception Nation LLC offers the following products. All prices are in USD.

• Exception Chronicles — Individual PDF documents, $27 each. Each Chronicle documents a specific medical situation, decision-making process, or outcome from the founder's personal history.

• Exception Bundle — All four Chronicles, $87.

The following products are in development and will be available at a future date. Pricing will be published at the time of launch.

• Exception Path — A digital membership providing access to ongoing documentation, updates, and member-only content. Coming soon.

• Don't Shatter — A single-session educational consultation. See Section 6 for scope and limitations. Coming soon.

• The Exception Resolve — An ongoing mentorship and documentation engagement. See Section 6 for scope and limitations. Coming soon.

Prices for active products are listed on the applicable product page. Any discrepancy between a product page and these Terms should be reported to support@exceptionnation.com.

4. Payment and Third-Party Processing

Payment for Exception Chronicles and the Exception Bundle is processed through Gumroad (Gumroad, Inc.), a third-party platform. When you purchase through Gumroad, you enter into a transaction governed in part by Gumroad's own Terms of Service and privacy practices. Exception Nation LLC is the seller of record for content purposes but does not store, process, or have direct access to your payment card information.

Exception Nation LLC is not liable for errors, outages, or disputes originating within Gumroad's platform. For payment processing issues, contact Gumroad support directly. For content or access issues, contact support@exceptionnation.com.

5. Refunds and Disputes

Digital downloads (Exception Chronicles, Exception Bundle): Because PDF files are delivered immediately upon purchase and cannot be returned, all sales are final after the file has been accessed or downloaded. Exception Nation LLC does not offer automatic refunds on digital products.

Exception Path membership, consulting engagements (Don't Shatter, The Exception Resolve): These products are not yet available. Refund and cancellation terms will be published at launch.

If you have a dispute or believe an error has occurred, contact support@exceptionnation.com. Exception Nation LLC reviews disputes on a case-by-case basis and may, at its sole discretion, issue a credit or resolution. Initiating a chargeback through your financial institution before contacting us may result in suspension of account access pending resolution.

6. Consulting Services — Scope and Limitations

Note: Consulting engagements (Don't Shatter and The Exception Resolve) are not yet available. This section describes their scope and legal limitations in advance of launch so that users understand what these services are — and are not — before they become available.

When available, consulting offered through Exception Nation will be structured as education and mentorship — not medical consultation, clinical assessment, or professional health guidance of any kind.

Don't Shatter will be a single educational consultation in which the founder shares his personal decision-making framework for navigating medical situations involving the musculoskeletal system — derived from his own experience with rotator cuff repair, distal bicep tenodesis, and long-term strength training at age 60. This engagement:

• Does not assess your specific medical condition

• Does not constitute diagnosis, prognosis, or treatment recommendation

• Does not replace evaluation by a licensed physician, orthopedic specialist, or physical therapist

• Cannot be characterized as a medical service under Texas law or any other jurisdiction

• Is educational conversation grounded in one person's documented personal experience

The Exception Resolve will be an ongoing mentorship and documentation engagement providing sustained access to the founder's thinking, research framework, and documentation process as applied to his own medical history. It carries the same limitations listed above — it is not clinical care, is not provided by a licensed professional, and does not create a provider-patient relationship under any applicable law.

Pricing for both engagements will be published at launch. By engaging in any consulting engagement when available, you represent that you understand and accept these scope limitations and that you are not relying on any consulting communication as medical advice.

7. Intellectual Property

All content on ExceptionNation.com — including but not limited to Exception Chronicles, articles, essays, videos, brand names, logos, and structural formatting — is the property of Exception Nation LLC and is protected under applicable United States copyright law.

ExceptionNation™, Exception Chronicles™, Exception Path™, The Exception Resolve™, and Don't Shatter™ are trademarks of Exception Nation LLC.

Purchasing a product grants you a personal, non-transferable, non-exclusive license to access and read the purchased content for your own private use. This license does not permit:

• Reproduction or copying of any content, in whole or in part, for distribution

• Resale or sublicensing of any purchased content

• Sharing downloadable files with individuals who have not purchased them

• Republication of any portion of content on any platform, website, or medium without written permission from Exception Nation LLC

• Use of the Exception Nation name, logo, or brand assets without written authorization

Violations of this license may result in account termination and legal action.

8. Disclaimers

All content on ExceptionNation.com is provided "as is" without warranties of any kind, express or implied. Exception Nation LLC makes no representation that any information published will produce any particular result in any reader's life or health.

• No outcome — health, physical, or otherwise — is promised, implied, or warranted by any content, Chronicle, or future product or engagement.

• The founder's documented outcomes reflect his specific circumstances, decisions, and biology. They are not predictive of outcomes for any other individual.

• Exception Nation LLC does not warrant the accuracy of third-party research or citations referenced in its content, though reasonable care is taken in their selection.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Exception Nation LLC, its members, managers, employees, contractors, and agents shall not be liable for:

• Any health decision made by a reader or purchaser based on content accessed through ExceptionNation.com

• Any physical, financial, or other harm arising from reliance on content, Chronicles, or any future product or communication

• Any indirect, incidental, consequential, punitive, or special damages of any nature

• Loss of data, access interruptions, or third-party platform failures (including Gumroad)

In no event shall the aggregate liability of Exception Nation LLC to any individual user exceed the total amount paid by that user to Exception Nation LLC in the twelve (12) months preceding the claim.

No Provider-Patient Relationship: Accessing any content on ExceptionNation.com or purchasing any product does not create a physician-patient relationship, therapist-client relationship, or any other professional care relationship between Exception Nation LLC (or the founder) and the user. No such relationship is offered or implied by any current or future product.

10. User Conduct

By using this site you represent that you are at least 18 years of age.

By using this site, you agree not to:

• Misrepresent your identity or affiliation when contacting Exception Nation LLC

• Attempt to circumvent access controls on membership content

• Use content from this site in any manner that violates applicable law

• Submit false, harassing, or fraudulent communications to support@exceptionnation.com

• Attempt to reverse-engineer, scrape, or systematically copy site content

11. Privacy

Exception Nation LLC collects only the personal information necessary to fulfill purchases and respond to support inquiries. Email addresses collected through the site are used solely for ExceptionNation communications and are not sold or shared with third parties for marketing purposes.

Payment data is handled exclusively by Gumroad. Exception Nation LLC does not collect or store payment card information.

12. Third-Party Links and References

ExceptionNation.com may reference or link to third-party websites, research publications, or resources. These links are provided for informational context only. Exception Nation LLC does not endorse, control, or assume responsibility for the content or practices of any third-party site. Inclusion of a link does not constitute a recommendation or affiliation.

13. Modifications to These Terms

Exception Nation LLC reserves the right to modify these Terms at any time. When material changes are made, the "Last updated" date at the top of this page will be revised. Continued use of the site or any product after a revision constitutes acceptance of the updated Terms. If you do not agree to revised Terms, discontinue use and cancel any active membership.

14. Governing Law, Disputes, and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. You agree that any dispute arising under these Terms shall be resolved under Texas law.

Individual Disputes Only: All disputes must be brought on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding against Exception Nation LLC.

Informal Resolution First: Before initiating any formal proceeding, the disputing party must contact support@exceptionnation.com and allow Exception Nation LLC thirty (30) days to attempt informal resolution.

Venue: If informal resolution fails, any legal proceeding shall be filed in the appropriate state or federal court of competent jurisdiction in Texas. Both parties consent to personal jurisdiction and venue in Texas for this purpose.

15. Texas Consumer Protection Notice

Exception Nation LLC conducts business in compliance with the Texas Deceptive Trade Practices Act (DTPA). Nothing in these Terms, and nothing represented on ExceptionNation.com, constitutes a false, misleading, or deceptive act or practice as defined under Texas law. The site makes no false claims of credentials, no implied warranty of health outcomes, and no pricing representations inconsistent with those listed in Section 3.

If you believe you have experienced a deceptive practice, contact support@exceptionnation.com before pursuing any external remedy.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.

17. Entire Agreement

These Terms, together with any individual consulting engagement agreement signed separately, constitute the entire agreement between you and Exception Nation LLC regarding your use of ExceptionNation.com and its products. These Terms supersede any prior communications, representations, or agreements, whether written or oral.

This Privacy Policy describes how Exception Nation LLC ("Exception Nation," "we," "us," or "our") collects, uses, and handles information in connection with ExceptionNation.com and its related email communications. We have written this policy to be specific and honest about actual practices — not to cover hypothetical scenarios. If you have questions, contact us at support@exceptionnation.com.

1. Who We Are

Exception Nation LLC is a Texas limited liability company operating ExceptionNation.com, a digital health nonfiction documentation property. Our registered state is Texas, and Texas law governs this policy.

2. What Information We Collect

We collect the following information — nothing more.

• Email address. When you voluntarily submit your email address through an opt-in form on ExceptionNation.com, that address is collected by Kit (formerly ConvertKit), our third-party email marketing platform. You provide this information with your explicit consent. We use it to send Exception Nation updates, content releases, and offers. You can unsubscribe at any time via the unsubscribe link included in every email we send. Kit handles all unsubscribe mechanics.

• Purchase information. If you purchase a product through ExceptionNation.com, the transaction is processed by Gumroad, a third-party payment processor. Exception Nation does not collect, see, store, or process your payment card data, billing address, or other financial information. That data is governed entirely by Gumroad's terms and privacy policy.

• Hosting-level data. ExceptionNation.com is hosted on Hostinger. Hostinger may collect standard server log data (such as IP addresses and browser type) as part of normal hosting operations. We do not access or use this data independently.

We do not have account creation or login functionality on ExceptionNation.com. No user profiles are stored on our servers.

3. Cookies and Tracking

Exception Nation does not set cookies directly. We do not use Google Analytics or any other analytics platform on ExceptionNation.com at this time. Third-party services embedded on the site — including Kit opt-in forms and Gumroad checkout links — may set their own cookies governed by their respective privacy policies (see Section 5 below). We have no control over third-party cookies and encourage you to review those policies directly.

4. How We Use Information

The only personal information we access is your email address, which we use solely to:

• Send Exception Nation content updates, product announcements, and editorial communications that you consented to receive when you opted in.

• Respond to direct inquiries or data requests submitted to support@exceptionnation.com.

We do not use your email address for any other purpose. We do not engage in behavioral profiling, retargeting, or data enrichment.

5. Third-Party Processors

Two third-party platforms receive data in connection with ExceptionNation.com. Data shared with these platforms is governed by their own privacy policies and terms of service. Exception Nation is not responsible for third-party data practices.

• Kit (ConvertKit) — Email marketing platform that collects and stores email addresses from our opt-in forms and manages email delivery and unsubscribes.

We do not share your personal information with any other third parties.

Exception Nation LLC relies on the data processing terms published by each named processor. Users are encouraged to review each processor's privacy policy at the links above.

6. We Do Not Sell Your Data

Exception Nation LLC does not sell, rent, trade, or transfer your email address or any other personal information to third parties for commercial purposes. This policy will be updated before any such practice changes, and users will be notified in advance. Your contact information exists in our Kit account for the purpose of delivering the content you opted in to receive — nothing else.

7. Children's Privacy

ExceptionNation.com publishes content intended for adults. We do not knowingly collect personal information from:

• Children under 13 (per the Children's Online Privacy Protection Act, COPPA); or

• Minors under 16 (per the California Consumer Privacy Act as amended by the California Privacy Rights Act of 2020, and the Oregon Consumer Privacy Act effective 2026).

If you believe a minor has submitted personal information to us in error, contact us at support@exceptionnation.com and we will delete it promptly.

8. California Residents — Your CCPA Rights

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

• Right to Know. You may request disclosure of the categories and specific pieces of personal information we have collected about you.

• Right to Delete. You may request deletion of personal information we hold about you, subject to applicable exceptions.

• Right to Correct. You may request correction of inaccurate personal information we hold about you.

• Right to Opt Out of Sale or Sharing. Exception Nation LLC does not sell or share personal information as defined under CCPA/CPRA. There is nothing to opt out of, and no "Do Not Sell or Share My Personal Information" link is applicable to our current practices. We state this explicitly rather than leaving it ambiguous.

• Right to Non-Discrimination. We will not discriminate against you for exercising any of these rights.

Exception Nation LLC recognizes and respects Global Privacy Control (GPC) opt-out preference signals. Because we do not sell or share personal information, receipt of a GPC signal has no additional operational effect on your data — your information is already protected at the level the signal requests.

To exercise any of these rights, contact us at support@exceptionnation.com. We will respond within 45 days as required by law.

8a. Oregon Residents — Your Privacy Rights

Oregon residents have rights under the Oregon Consumer Privacy Act, including the right to know what personal information we hold about you, the right to request deletion of that information, and the right to correct inaccurate information. To exercise these rights, contact support@exceptionnation.com. We will respond within 45 days.

9. This Is Not a Medical Records System

Exception Nation is a digital content property — specifically, a nonfiction documentation site. We do not collect health information, medical records, diagnoses, treatment data, or any protected health information (PHI) as defined by HIPAA. Exception Nation LLC is not a covered entity under HIPAA, is not a healthcare provider, and does not operate a patient portal or clinical system of any kind. No health data is stored by Exception Nation. This policy is not a HIPAA Notice of Privacy Practices, and HIPAA does not apply to Exception Nation's operations.

10. Data Security

We rely on Kit and Gumroad's security infrastructure to protect data processed through those platforms. We access our Kit account using standard security practices including strong passwords. We do not store personal data on our own servers beyond what Hostinger logs as part of standard hosting operations. No method of transmission or storage is 100% secure. If you have security concerns, contact support@exceptionnation.com.

In the event of a data security incident affecting your personal information, Exception Nation LLC will notify affected users as required by applicable law, including the Texas Identity Theft Enforcement and Protection Act (Tex. Bus. & Com. Code §521).

11. Data Retention

Your email address remains in our Kit account for as long as you are subscribed. When you unsubscribe, Kit removes you from active mailing lists per its standard process. You may also request deletion of your email address at any time by emailing support@exceptionnation.com.

12. Governing Law

This Privacy Policy is governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from this policy shall be resolved in the appropriate courts of Texas.

13. Changes to This Policy

If we materially change our data practices, we will update this page and revise the "Last updated" date at the top. We will not retroactively apply changes in ways that reduce your rights without notice. Continued use of ExceptionNation.com after a policy update constitutes acceptance of the revised terms.
